1.Purpose
These Terms and Conditions of Use define the terms of access and use of the Orack Eval platform, accessible at eval.orackgroup.com. Orack Eval is an online indicative land evaluation service in Ivory Coast, based on the analysis of 20 indicators covering location, infrastructure, land status, and environment. Use of the platform implies full and complete acceptance of these Terms and Conditions.
2.Access to the Service
Access to the platform is open to any individual or legal entity. Some features are freely accessible (basic evaluation), while others require the creation of a free account (favorites, history) or a paid subscription (detailed report, unlimited evaluations). Orack Group reserves the right to temporarily suspend or interrupt access to the platform for maintenance or update purposes, without prior notice or compensation.
3.Account Creation
Account creation requires a valid email address and a secure password. The user is responsible for the confidentiality of their login credentials and for all activity carried out from their account. In case of unauthorized use of their account, the user must immediately notify Orack Group at contact@orackgroup.com.
4.Description of Services
Orack Eval offers the following services: • Indicative land evaluation based on 20 geographic, land, infrastructure, and environmental indicators • Generation of an overall score and module scores (location, infrastructure, land status, environment) • Saving evaluations in a personal space (registered members) • Access to informational content about Ivorian real estate (Infos Immo section) Results are automatically generated from public and open data. They do not replace professional expertise.
5.User Obligations
The user agrees to: • Use the platform in accordance with its intended purpose and the laws in force in Ivory Coast • Not attempt to circumvent security measures or access restrictions • Not use robots, scrapers, or any other automated means to extract data from the platform • Not reproduce, resell, or redistribute the platform's content without authorization • Provide accurate information when creating their account
6.Intellectual Property
The Orack Eval platform, its evaluation algorithm, its database, its interfaces, and all its content are protected by intellectual property law. The user is granted a personal, non-exclusive right to use the platform. Any commercial exploitation of evaluation results requires the prior written consent of Orack Group.
7.Limitation of Liability
Evaluations provided by Orack Eval are delivered for indicative purposes only. They do not constitute a land appraisal, legal advice, or investment advice. Orack Group disclaims all liability in case of: • Decisions made by the user based on the evaluations provided • Inaccuracy, obsolescence, or incompleteness of the data used • Temporary service interruption for maintenance or force majeure • Damages resulting from the use or inability to use the platform Users are expressly advised to consult a qualified professional (land surveyor, notary, licensed real estate agent) before any land purchase or sale decision.
8.Termination
The user may delete their account at any time from their personal space settings or by sending a request to contact@orackgroup.com. Orack Group reserves the right to suspend or delete an account in case of violation of these Terms and Conditions, without prior notice or compensation.
9.Modification of Terms
Orack Group reserves the right to modify these Terms and Conditions at any time. Users will be notified of any substantial changes by notification on the platform or by email. Continued use of the platform after modification of the Terms and Conditions constitutes acceptance of the new conditions.
10.Applicable Law and Jurisdiction
These Terms and Conditions are governed by Ivorian law, including: • Law No. 2013-451 of June 19, 2013, on combating cybercrime • Law No. 2013-450 of June 19, 2013, on the protection of personal data • Ordinance No. 2012-293 of March 21, 2012, on telecommunications and ICT In the event of a dispute relating to the interpretation or performance of these Terms, the parties shall endeavor to find an amicable solution. Failing that, the courts of Abidjan (Ivory Coast) shall have sole jurisdiction.
